Welcome to House of Stephie. These Terms of Service (“Terms”) govern your access to and use of our website and online store (the “Services”), which are powered by Shopify. By using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

References to "we", "us", and “our” refer to House of Stephie. References to “you” and “your” refer to the customer using the Services.

SECTION 1 – ELIGIBILITY AND ACCOUNT

By using the Services, you confirm that you are at least the age of majority in your jurisdiction or that you have parental or guardian consent to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer or assign your account to any other person.

You agree to provide accurate, current, and complete information when creating an account or placing an order, and to keep that information updated.

SECTION 2 – PRODUCTS

We make every effort to display our products accurately. However, colors and appearance may vary depending on your device settings. We do not warrant that product quality or appearance will meet your expectations exactly as displayed.

Product descriptions, availability, and pricing are subject to change without notice. We reserve the right to discontinue any product or limit order quantities at our sole discretion.

SECTION 3 – ORDERS

Placing an order constitutes an offer to purchase. We reserve the right to accept, decline, or modify any order for any reason. An order is only accepted once we confirm it in writing and receive payment. Please review your order carefully before submitting, as we may be unable to cancel or modify accepted orders.

If we cancel or modify your order, we will notify you using the contact information provided at checkout. All purchases are for personal or household use only and may not be resold or exported commercially.

SECTION 4 – PRICING AND PAYMENT

Prices are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as confirmed in your order confirmation email. Unless stated otherwise, prices do not include taxes, shipping, handling, or import/customs charges.

You agree to provide accurate and complete payment information. You represent that you are authorized to use the payment method provided and that charges will be honored by your payment provider. We may offer promotional pricing governed by separate terms; in case of conflict, the promotion terms will prevail.

SECTION 5 – SHIPPING AND DELIVERY

All delivery timeframes are estimates and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or circumstances beyond our control. Risk of loss and title for products transfers to you upon handover to the carrier.

SECTION 6 – INTELLECTUAL PROPERTY

All content on the Services — including text, images, graphics, logos, product descriptions, video, and audio — is the property of House of Stephie or its licensors and is protected by applicable intellectual property laws. You may use the Services for personal, non-commercial purposes only.

You may not reproduce, distribute, modify, or exploit any part of the Services without our prior written consent. All trademarks and brand names displayed are the property of their respective owners.

SECTION 7 – THIRD-PARTY TOOLS AND LINKS

The Services may include optional third-party tools and links to external websites. These are provided 'as is' and we make no warranties regarding them. We are not responsible for the content, accuracy, or practices of any third-party sites. Your use of third-party tools or sites is at your own risk.

SECTION 8 – SHOPIFY RELATIONSHIP

House of Stephie is powered by Shopify. All sales and purchases are made directly with House of Stephie. Shopify is not responsible for any aspect of your transactions, including any injury, damage, or loss resulting from products purchased. You hereby release Shopify and its affiliates from all claims arising out of your purchases from House of Stephie.

SECTION 9 – PRIVACY

Your use of the Services is subject to our Privacy Policy and Shopify's Privacy Policy. By using the Services, you acknowledge and consent to the collection and processing of your personal information as described in those policies, including transfer to Shopify and its partners in other jurisdictions.

SECTION 10 – USER FEEDBACK

By submitting any feedback, reviews, suggestions, or other content (“Feedback”) to us, you grant House of Stephie a perpetual, worldwide, royalty-free licence to use, reproduce, modify, and distribute such Feedback for any purpose, including improving and promoting the Services.

You represent that you own or have the right to submit all feedback and that it does not infringe any third-party rights or contain harmful, unlawful, or misleading content. We are not obligated to keep feedback confidential or to compensate you for it.

SECTION 11 – ERRORS AND INACCURACIES

We reserve the right to correct any typographical errors, inaccuracies, or omissions — including in product descriptions, pricing, availability, or promotions — at any time without notice, including after an order has been submitted.

SECTION 12 – PROHIBITED USES

You agree to use the Services only for lawful purposes. You may not use the Services to: (a) violate any applicable law or regulation; (b) infringe on intellectual property rights; (c) harass, defame, or harm any person; (d) transmit false or misleading information; (e) distribute spam, viruses, or malicious code; (f) scrape or extract data using automated tools, robots, spiders, or AI agents without our written consent; or (g) interfere with the security or operation of the Services.

We reserve the right to suspend or terminate your account at any time for violation of these Terms.

SECTION 13 – AUTOMATED AGENTS

Any automated software or agent (“Agent”) accessing the Services must: (i) identify itself as an Agent in all HTTP/HTTPS requests; (ii) not mimic human behavior or bypass security measures such as CAPTCHAs; (iii) respond truthfully when asked whether interactions are from a human or computer; and (iv) comply with any restrictions we impose on Agent access. We may limit or block Agent access at any time.

SECTION 14 – DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

SECTION 15 – LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSE OF STEPHIE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SECTION 16 – INDEMNIFICATION

You agree to indemnify and hold harmless House of Stephie, Shopify, and their respective affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, or expenses (including reasonable legal fees) arising from: (1) your breach of these Terms; (2) your violation of any law or third-party rights; or (3) your use of the Services. We will notify you of any such claim promptly.

SECTION 17 – TERMINATION

We may terminate or suspend your access to the Services at any time, without notice, for any reason, including breach of these Terms. Upon termination, you remain liable for all amounts due. Sections relating to Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law will survive termination.

SECTION 18 – GENERAL PROVISIONS

Severability: If any provision of these Terms is found to be unlawful or unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will continue in full force.

Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that right.

Entire Agreement: These Terms, together with our Privacy Policy and any applicable promotion terms, constitute the entire agreement between you and House of Stephie regarding the Services.

Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without notice.

Governing Law: These Terms are governed by the laws of the jurisdiction in which House of Stephie is headquartered, and disputes will be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Changes to Terms: We may update these Terms at any time. Material changes will be communicated in accordance with applicable law. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
